D’AUBE does not claim that Motion Foundry checkout, authenticated premium entitlement or creator payout automation is active until production evidence confirms it.

1. Scope and acceptance

These terms apply to D’AUBE SONNTAG public websites, digital products, Motion Foundry works, commissioned adaptations, creator submissions and related support. Accessing a public page does not create a paid contract. A paid contract begins only when D’AUBE accepts an order or commission in writing and the stated payment conditions are satisfied.

Product-page summaries are convenience descriptions. The applicable order, licence, statement of work and item-specific terms control if they conflict with a summary.

2. Access tiers and entitlements

Open works may be used only within their stated licence. Atelier and Signature materials require a valid entitlement. Premium prompts, source packets and gated files may not be copied, shared, resold, published, scraped or used to bypass access controls.

A displayed price is not a binding offer until checkout or a written order is active. D’AUBE currently treats preview pricing as an offer hypothesis where payment and entitlement runtime are not yet enabled.

3. Licence and intellectual property

Unless an item states otherwise, purchase grants a limited, non-exclusive, non-transferable right to use the purchased material for the permitted number and type of projects. Ownership of D’AUBE prompts, systems, documentation, visual direction and source material does not transfer.

Customers remain responsible for third-party fonts, photographs, video, models, trademarks, software and other assets introduced into a generated or adapted implementation. No D’AUBE licence grants rights that D’AUBE does not own.

4. AI-assisted output and production readiness

Motion Foundry materials are implementation inputs for professional teams and AI coding tools; they are not a guarantee of a particular output. Models, tools and generated code can vary, omit requirements or introduce defects.

Generated output is not production-ready merely because a prompt is labelled production-oriented. The customer must complete security, accessibility, performance, rights, browser, device, data-protection and deployment verification appropriate to the implementation.

5. Acceptable use

You may not use D’AUBE services to infringe rights, impersonate others, distribute malware, deceive customers, fabricate evidence, evade lawful controls, attack systems, automate abusive access or create unlawful content.

D’AUBE may suspend access when reasonably necessary to protect users, creators, infrastructure, intellectual property or legal compliance. Material decisions should be documented and proportionate to the identified risk.

6. Creator submissions

Creators must accurately disclose authorship, AI assistance, source material and asset rights. Submitting work does not guarantee acceptance or payment. Any reward, licence, attribution, exclusivity or buyout must be stated in the applicable creator agreement before publication.

Creators must not submit copied, misappropriated or access-controlled third-party material. D’AUBE may request evidence, reject a submission or remove a work when rights or quality evidence is insufficient.

7. Commissions and delivery

Commission scope, deliverables, revision limits, dependencies, acceptance criteria, timeline, fees, deployment responsibility and support period must be stated in a written order or statement of work.

Delays caused by missing customer content, approvals, credentials, rights or technical access may move the delivery schedule. D’AUBE will not request secrets through an insecure public channel.

8. Cancellation, defects and returns

Cancellation, digital-delivery recovery, defect resolution and any refund eligibility follow the published Returns policy and the applicable item or commission contract. Statutory consumer rights remain unaffected where they apply.

Access may be revoked after a valid refund, chargeback or fraudulent transaction. Copies already used remain subject to the licence and intellectual-property restrictions.

9. Warranty and liability boundary

Public and open materials are provided as available unless a written contract states otherwise. To the maximum extent permitted by law, D’AUBE does not promise uninterrupted availability, universal tool compatibility, guaranteed revenue, guaranteed search ranking or defect-free generated output.

Nothing in these terms excludes liability that cannot lawfully be excluded. Any contractual cap or remedy for a paid order must be stated in the applicable agreement and interpreted under mandatory law.

10. Privacy, changes and contact

Personal-data handling follows the Privacy notice. Material changes to these terms will be published with a revised effective date. Changes do not retroactively remove rights already granted under a completed written order unless the parties lawfully agree otherwise.
